“Auctioneer” - means Technological Solutions (Pty) Ltd T/A The Auction Hub situated at Plot 17073, Gaborone West, Gaborone and contact number 76754579“Bidding Platform” means auctionhub.co.bw "Seller" means a person, natural or juristic, who is the lawful owner of the assets, and who is entitled by law to sell the assets; ."Bidder" refers to any individual or entity participating in the auction."Auction" refers to the process of selling goods or property through competitive bidding."Item" means any product, asset, or property listed for auction." No Reserve" means that there is no established minimum price for the item being auctioned. This means that no matter what the winning bid, the owner must sell it for that amount."Reserve Price" means a minimum price that has to be attained for the bid to be acceptedListing items for auction. Marketing and promoting the auction. Facilitating bidding and sale processes. Collecting payments (if applicable).Assist in handover or delivery coordination.Provide accurate, complete, and lawful descriptions of all items. Ensure they have full ownership and rights to sell the items. Provide supporting documents where required. Pay all applicable service charges and commissions.Register on the platform or with the auctioneer before bidding. Provide accurate personal and contact details. Honour all winning bids and complete payment within the stipulated timeframe.The Seller may set a reserve price for any item. The Service Provider reserves the right to decline listings that violate laws or internal policies.All bids are binding once placed. The highest valid bid at auction close will be deemed the winning bid. The Service Provider may extend or cancel an auction in case of technical or legal issues.Winning Bidders must effect full payment of the purchase price (including the bid amount, commission, fees and VAT(where applicable)) within 48 HOURS of sending of the email notification and Tax Invoice confirming they have won the bid. Payment must reflect the reference number on the pro forma invoice. In the event that the Purchaser does not effect full payment within 48 hours of the email notification, The Purchaser expressly and unequivocally acknowledges and agrees that the lot may be resold on the Auctioneer’s online bidding platform;The Service Provider may collect payments on behalf of the Seller. Late payments may incur penalties or cancellation.Commission rates shall be agreed prior to listing. Additional marketing or premium listing fees may apply. Fees are non-refundable unless otherwise stated.Items are sold as-is unless otherwise specified. Bidders are encouraged to inspect items before bidding. The Auctioneer is not liable in any way for any errors or inaccuracies in the description or identification of any lot. In making a bid, a bidder shall be deemed to have acquainted himself fully with the goods in the lot on which he bids. The Auctioneer gives no warranties as to the correctness of information on a lot, including but not limited to, year of first registration, year of manufacturing, odometer reading and service historyThe Service Provider is not liable for undisclosed defects unless due to negligence.The Seller may withdraw an item before the auction start, subject to fees. The Service Provider may cancel or suspend an auction for legal, technical, or policy reasons.The Service Provider shall not be held liable for:Liability is limited to the amount of service fees paid.The information collected and maintained within this application will be used to support an individual’s participation in online bidding on the platform. The information on this website will not be shared with any parties external to the Auctioneer without express consent from the Seller Personal data will be used solely for auction-related communication and processingThe Service Provider shall comply with applicable data protection laws.All platform content, logos, and materials remain the Service Provider's intellectual property. The Seller grants rights for the Service Provider to use item images and descriptions for marketing purposes.In the event of any dispute arising between a Bidder and/or Purchaser and the Owner of a lot, the Parties agree that the Auctioneer will not form part of any such dispute and that the matter must be resolved between the Bidder and/or Purchaser and the Owner directly Parties agree to attempt amicable resolution first. If unresolved, disputes shall be subject to arbitration or the courts of the governing jurisdiction.These terms shall be governed by the laws of Botswana.Removal of any lot by the purchaser will not take place until payment of the full purchase price (including the bid amount, commission, fees, storage/standing and VAT) has been made to the Auctioneer and reflect in the Bank account of the Auctioneer. Each lot is sold separately but may be invoiced collectively.
